Missouri workers compensation laws require the insurer or employer to provide medical treatment to their employees. It is the responsibility of the employer or insurer to cover all costs for authorized medical treatment, prescriptions and medical devices. There should be no costs or deductible. Unfortunately, the employer, or the insurer on the employers’ behalf, has the right to choose a healthcare provider or treating physician. Often times this leads to delayed medical care or denial of treatment. Why Does my Employer Choose my Workers Compensation Doctor?

The Workers Compensation Law gives the employer the right to select the healthcare provider(s) for the injured employee. Often times the employer delegates the right to select the healthcare provider to the work comp insurance company. The employer or workers comp insurance company has a qualified right to select or authorize a change in physician if they were to disagree with the treating physician. However, the employer or workers compensation insurance may authorize you to see your own doctor.

If the employer or workers compensation insurance company does not authorize you to see your own doctor, the injured employee may select his or her own physician at their own expense. While employees have a right to choose their treating physician, often times a separate health insurance policy will not cover such medical treatment as many health insurance policies have an exclusion for work related injuries.

Traveling for Workers Compensation Medical Treatment

When an employee is required to receive medical treatment from a doctor outside of the local or metropolitan area from the employee’s principle place of employment, the employer is required to pay the reasonable and necessary travel expenses. The employer or workmans compensation insurer is not responsible for costs incurred beyond 250 miles each way from the place of treatment. If you are an injured employee residing outside of the State of Missouri, you may select a treatment location within 100 miles of your residence, place of injury or the place of hire by the employer.
