Learn your rights to Workers Compensation Benefits if  you are injured on the job.

Our Rights to Workers Compensation section is offered as a way to inform injured workers of the benefits available should they be injured on the job. If you have any questions regarding your workers comp rights not answered in this section, please do not hesitate to contact the experienced workers compensation attorneys at Roskin & Hoffmann, LLC.

The following topics are discussed in the Your Rights to Workers Compensation section:

Covered Work Injuries: Any injury or occupational disease that arose out of and in the course of employment is a covered work injury for the purpose of bringing a workers compensation claim. In order to prevail in a MO workers compensation case, the worker must be able to show that he or she suffered an accident or occupational hazard and that was the prevailing factor in causing the resulting medical condition and disability.

Steps to Take When Injured on the Job: The first thing that an injured worker in MO must do to protect his or her workers compensation rights is report the injury to his or her employer. There is a 30 day window to accomplish this, and failure to do so can jeopardize your MO workers compensation rights. The notification needs to be in writing, and a copy of the notice should be maintained for your own personal records. Hiring and experienced workers compensation attorney near you is also wise.

Timeline for Filing a Workers Compensation Claim: Whenever a worker is injured at his or her place of employment, there is a limited amount of time to file a workers comp claim with the MO Division of Workers Compensation. This limit is commonly known as a statute of limitations and works in a similar fashion for injured MO workers. Typically, an injured worker in MO has 2 years from the date of the injury, or 2 years from the last date a benefit payment was made to file a claim for work comp.

Workers Compensation Benefits: A work related injury can be a traumatic experience. If you or a loved one has been injured on the job or exposed to an occupational disease in the course and scope of your employment, the Missouri Workers Compensation Law provides certain benefits for the injured worker and their family.

Settling a Workers Comp Case: Near the end of every MO workers compensation case, after treatment has been completed and all other issues have been resolved, the insurance company or employer will make a settlement offer. At this point, most injured workers do not know what is a fair amount to settle for and the workers comp insurance companies and employers know this. A workers compensation attorney can help get the most our of your case.

Problems Receiving Work Comp Benefits: In most MO workers compensation cases, the injured worker will encounter problems getting the benefits that they deserve. Either there is a delay in getting them or they are denied completely. An experienced workers compensation attorney can help with all of these benefits.
