Be familiar with what is required of the insurer under the Missouri Workers Compensation Laws.

Chapter 287, Section 128, of the Missouri Revised Statutes establishes a fraud and noncompliance administrative unit in the Division of Workers Compensation that is responsible for investigating incidences of fraud and failure to comply with the provisions of the statute.

The new law makes it unlawful for any person to knowingly make or cause to be made a false or fraudulent material statement to an investigator of the Division of Workers Compensation who is investigating an allegation of fraud or noncompliance.

Knowingly and intentionally refusing to comply with workers compensation obligations to which an insurance company or self-insurer knows an employee is entitled is a class D felony, punishable by a fine of up to $10,000.00 or double the value of the fraud, whichever is greater. A subsequent violation is a class C felony.

Reporting Workers Compensation Insurance Fraud

Any person may file a complaint alleging insurer fraud with the Workers Compensation Fraud and Noncompliance Unit. All investigations conducted by the Fraud and Noncompliance Unit are criminal in nature and must be kept confidential. Due to the confidentiality of the investigations, persons lodging complaints are not provided information on the outcome of the investigation prior to prosecution. If the investigation reveals a violation of the statute, the Workers Compensation Fraud and Noncompliance Unit present the findings of fraud to the director of the Division of Workers Compensation. The director may refer the case to the Missouri Attorney General for prosecution.

Any fines or penalties levied and received as a result of prosecution under this law shall be paid to the Workers Compensation Fund. The Fraud and Noncompliance Unit does not settle claims or pay benefits to the injured employee.
