Workers Compensation: Steps to Take When Injured

Missouri Workers Compensation Lawyer
Roskin & Hoffmann, LLC

Familiarize yourself with the Missouri Workers Compensation system if you suffer a workplace injury.

The first thing that an injured worker in MO must do to protect his or her workers compensation rights is report the injury to his or her employer. There is a 30 day window to accomplish this, and failure to do so can jeopardize your MO workers compensation rights. The notification needs to be in writing, and a copy of the notice should be copied for your own personal records.  Also include the nature of the injury, where and when it occurred and the name and address of the person injured.

Receiving Medical Treatment under Workers Compensation

At this point you should be seeking medical treatment. Your employer or the workers comp insurance company for your employer should provide you with a location for you to seek treatment from. If this is not given you should seek legal counsel as soon as possible. Your employer is also required to file a report of injury with the MO division of workers compensation.

If you are unable to work during this time you may be entitled to temporary total disability payments.  This means you could be receiving weekly checks for 66 and 2/3 of your average weekly wage for the time you are unable to return to work. A workers compensation attorney can help you with all of the above.

Independent Medical Examination under Workers Compensation

If you have been released from care by the doctor provided by the employer or work comp insurance company and you believe that you need more medical treatment, you have the right to obtain an independent medical examination from another doctor. This very important step can mean the difference between getting more treatment and being forced to live with whatever problems you are still experiencing. At Roskin & Hoffmann, LLC, our workers compensation attorneys we work with doctors all of the time who are able to review your case and give an opinion as to your need for more medical treatment. This examination is your right and should be used whenever necessary.  Additionally, by obtaining an independent medical examination, you might obtain medical evidence to prove that you are entitled to more money at the end of your workers comp case. Having a medical expert report that you have a higher disability than what the insurance company doctor says you have provides evidence that you are in fact more injured than the original doctor says you were.

These steps are just a part of the workmans compensation process of making sure that you protect all of your rights. An experienced law firm like Roskin & Hoffmann, LLC will help to protect your workers comp rights and make sure you get everything that you are entitled to. Since we don’t get paid until you get paid, there is really nothing to lose by calling for a free consultation today.
