The Missouri statute applicable to workers compensation fraud and noncompliance can be found at §287.128, RSMo. This statute creates the Fraud and Noncompliance unit within the Division of Workers Compensation and outlines most of the violations the Fraud and Noncompliance Unit are authorized to investigate. The Fraud and Noncompliance Unit is responsible for investigating all allegations of fraud or noncompliance involving workers compensation throughout the state of Missouri.

This section of our website is intended to provide an overview of the Fraud and Noncompliance Unit of the Division of Workers Compensation. To help you better understand your rights as an injured employee, we will address the following topics in this section:

Workers Compensation Employer Fraud: This usually happens: (1) when an employer misrepresents an employee’s job classification to obtain insurance at less than the proper rate, (2) when an employer knowingly makes a false or fraudulent statement regarding an employee’s work comp entitlement benefits to discourage the worker from making a legitimate workers compensation claim or (3) when an employer knowingly makes a false or fraudulent material statement or representation to deny workers comp benefits to an injured worker.

Workers Compensation Insurer Fraud: This usually happens when a workers compensation insurer knowingly and intentionally refuses to comply with the workers comp obligations a injured employee is entitled.

Workers Compensation Employer Noncompliance: This usually happens when an employer knowingly fails to insure workers compensation liability or willfully fails to post the notice of workers compensation at the workplace.
